Overview
Welcome to Art Lectio.
These Terms of Service apply to the Art Lectio website, online store, products, content, tools, features, and services, together referred to in these Terms as the “Services”.
The terms “Art Lectio”, “we”, “us”, and “our” refer to Tom Gibbs Art trading as Art Lectio, ABN 91 746 404 100.
Art Lectio is powered by Shopify, which enables us to provide our online store and related ecommerce services to you.
These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when you access or use the Services, browse our store, or purchase products from us.
Please read these Terms carefully. By visiting, interacting with, or using the Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, you should not access or use the Services.
Nothing in these Terms excludes, restricts, or modifies any rights or remedies you may have under Australian Consumer Law or any other law that cannot be excluded, restricted, or modified by agreement.
Section 1 — Access and account
By using the Services, you represent that you are at least the age of majority in your state, province, territory, or country of residence, or that you are using the Services with the consent and supervision of a parent or legal guardian.
To use certain parts of the Services, including placing an order, you may be asked to provide information such as your name, email address, billing information, payment information, shipping address, and other order details.
You represent and warrant that all information you provide to us is accurate, current, complete, and not misleading. You are responsible for keeping your account information up to date.
If you create an account, you are responsible for maintaining the confidentiality and security of your account credentials. You are responsible for all activity that occurs under your account unless the activity results from our failure to take reasonable care.
You must not transfer, sell, assign, or license your account to any other person without our prior written consent.
We may suspend, restrict, or terminate your access to the Services where reasonably necessary, including if we believe you have breached these Terms, used the Services unlawfully, engaged in fraudulent activity, or created a security, payment, or operational risk.
Section 2 — Our products
Art Lectio sells made-to-order fine art prints. Each print is produced after your order is placed.
We make reasonable efforts to display our products accurately, including artwork images, product descriptions, sizes, materials, paper details, and prices. However, colours and appearance may vary slightly depending on your screen, device settings, lighting conditions, and the natural characteristics of printed materials.
Minor colour variation, cropping variation, margin variation, or differences in scale shown in lifestyle images are not considered faults unless the product is materially different from the product description or otherwise fails to meet a consumer guarantee.
Unless expressly stated otherwise, Art Lectio prints are supplied unframed. Frames, mounts, props, and decorative objects shown in product images or lifestyle images are for display purposes only and are not included unless expressly stated in the product description.
Some Art Lectio products reproduce public-domain artworks or artworks made available under licence or open-access terms. Art Lectio does not claim ownership of underlying public-domain artworks. However, our brand, website content, product descriptions, original photography, product presentation, layout, design, selection, arrangement, and other original materials remain protected.
Unless expressly stated otherwise, Art Lectio products are not official products of, affiliated with, endorsed by, or sponsored by any museum, gallery, artist estate, rights holder, cultural institution, or other third party.
All product descriptions, prices, and availability are subject to change without notice. Changes will not affect orders we have already accepted unless required by law, expressly permitted under these Terms, or agreed with you.
We reserve the right to discontinue any product or limit sales of any product where reasonably necessary, including because of production constraints, suspected fraud, legal restrictions, stock or material limitations, or shipping limitations.
Nothing in this section limits any rights you may have under Australian Consumer Law or other applicable consumer protection laws.
Section 3 — Orders
When you place an order, you are making an offer to purchase the selected product or products.
An order is accepted when we confirm acceptance by email, begin processing the order, or submit the order for production, whichever occurs first.
We may decline, cancel, or amend an order where reasonably necessary, including where:
- payment is not authorised;
- payment is reversed or appears fraudulent;
- the product is unavailable;
- the delivery address is incomplete, unsupported, or unavailable;
- fulfilment is not reasonably possible;
- there is an obvious pricing, product, or availability error;
- the order appears fraudulent, unlawful, abusive, or in breach of these Terms;
- we are required to do so by law.
If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item or order using the original payment method, unless otherwise agreed with you or required by law.
Art Lectio products are produced to order. We use third-party production and fulfilment partners to print, pack, and ship orders. We remain responsible to you as the seller of the product. Customer service enquiries should be directed to Art Lectio, not to our production or fulfilment partners.
Please review your order carefully before submitting it, including artwork, size, quantity, currency, email address, shipping address, and billing details.
If you need to cancel or change an order, contact us immediately at hello@artlectio.com. We may be able to cancel or amend an order before it enters production. Once an order has entered production, cancellation or changes may no longer be possible because the print is already being made for you.
A cancellation or change is not confirmed until we have confirmed it by email.
Returns, replacements, cancellations, and refunds are handled in accordance with our Refund Policy, except where applicable law gives you additional rights.
You represent and warrant that your purchases are for personal, domestic, decorative, gift, or household use and are not for commercial resale unless we have agreed otherwise in writing.
Nothing in this section limits any rights you may have under Australian Consumer Law or other applicable consumer protection laws.
Section 4 — Prices and billing
Prices, discounts, and promotions are subject to change without notice.
The price charged for a product will be the price shown at the time you place your order, subject to these Terms.
The final amount payable before you submit your order will be shown at checkout.
Unless otherwise stated, product prices do not include shipping charges, which will be shown before checkout where applicable. Taxes, duties, and other charges will be displayed or applied as required by law and by our checkout settings.
International customers may be responsible for customs duties, import taxes, VAT, brokerage fees, or similar government charges that are not collected by us at checkout. These charges are set by the destination country or relevant authorities and are not controlled by Art Lectio.
Prices shown in our online store may differ from prices offered through third-party platforms, marketplaces, promotions, or other sales channels.
We may offer promotions from time to time. Promotions may be subject to additional terms and conditions. If there is a conflict between these Terms and the terms of a promotion, the promotion terms will apply to that promotion.
You agree to provide current, complete, and accurate purchase, payment, billing, and account information for all purchases made through our store.
You agree to promptly update your account and other information, including your email address, billing address, shipping address, and payment details, so that we can complete your transactions and contact you as needed.
You represent and warrant that:
- the payment information you provide is true, correct, and complete;
- you are authorised to use the payment method provided;
- charges incurred by you will be honoured by your payment provider;
- you will pay all charges incurred by you at the prices shown at checkout, including shipping and applicable taxes or charges.
Section 5 — Shipping and delivery
Shipping and delivery times are estimates only and are not guaranteed unless expressly stated otherwise.
We are not responsible for delays caused by carriers, customs processing, incorrect delivery information, local delivery disruptions, public holidays, severe weather, production delays outside our reasonable control, or events outside our reasonable control.
However, this does not limit any rights you may have under Australian Consumer Law or other applicable consumer protection laws.
You are responsible for providing a complete and accurate delivery address. If an order cannot be delivered because the delivery address you provided was incorrect or incomplete, we may need to charge you for redelivery or for a replacement order.
We may be unable to deliver to certain addresses, including some PO boxes, parcel lockers, military addresses, remote locations, or restricted destinations. Any delivery limitations may be described in our Shipping Policy or shown during checkout.
Risk in the product passes to you when the product is delivered to the delivery address provided with your order, unless otherwise required by law.
If your order is lost, damaged, defective, or incorrectly supplied, please contact us at hello@artlectio.com so we can assess the issue and arrange an appropriate remedy where required.
International orders may be subject to customs duties, import taxes, VAT, brokerage fees, or other government charges. Unless these charges are collected from you at checkout, they are your responsibility.

Section 6 — Returns and refunds
Because Art Lectio prints are made to order, we do not accept returns, exchanges, or refunds for change of mind, incorrect size selection, incorrect artwork selection, or preference-based reasons.
This does not affect your rights under Australian Consumer Law or any other consumer protections that apply in your country.
If your item arrives damaged, defective, incorrect, or materially different from the product description, please contact us at hello@artlectio.com as soon as possible with your order number and photographs of the item and packaging.
Returns must be approved before being sent back. Please do not return items to the sender address shown on the parcel, to our print partner, or to any address without prior approval. If a return is required, we will provide the correct return instructions by email.
Returns, replacements, reprints, cancellations, and refunds are handled in accordance with our Refund Policy.

Section 7 — Intellectual property
Our Services, including our brand name, logos, website copy, product descriptions, original photography, graphics, layout, design, selection, arrangement, and other original content, are owned by Art Lectio, its affiliates, or licensors and are protected by Australian and international intellectual property laws.
Some products reproduce public-domain artworks or artworks made available under licence or open-access terms. Art Lectio does not claim ownership of underlying public-domain artworks. However, our brand, website content, product descriptions, original photography, product presentation, designs, layout, selection, arrangement, and other original materials remain protected.
These Terms permit you to access and use the Services for your personal, non-commercial use, including browsing our store and purchasing products from us.
You must not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, scrape, copy, or transmit any material from the Services without our prior written consent, except as permitted by law.
Nothing in these Terms grants you any licence or rights in the intellectual property of Art Lectio, Shopify, or any third party, except as expressly stated in these Terms.
Art Lectio’s names, logos, product names, service names, designs, and slogans are trademarks, business names, or brand identifiers of Art Lectio or its licensors. You must not use these without our prior written permission.
Shopify’s name, logo, product names, service names, designs, and slogans are trademarks of Shopify. All other names, logos, product names, service names, designs, and slogans appearing on the Services are the property of their respective owners.
Section 8 — Optional tools
We may provide access to customer tools, features, apps, integrations, or services offered by third parties as part of the Services.
We do not control, monitor, or have input into all third-party tools. You acknowledge and agree that access to such tools may be provided “as is” and “as available” without warranties, representations, or conditions of any kind, except to the extent required by law.
Your use of optional third-party tools is at your own risk and discretion. You should ensure that you are familiar with and agree to the terms on which those tools are provided by the relevant third-party provider.
We may offer new features, tools, resources, or services through the Services in the future. Such new features, tools, resources, or services will also be subject to these Terms unless additional terms apply.
Nothing in this section limits any rights you may have under Australian Consumer Law or other applicable consumer protection laws.
Section 9 — Third-party links
The Services may contain materials, links, or embedded functionality provided by third parties.
Third-party links are provided for convenience only. We are not responsible for examining or evaluating the content, accuracy, availability, practices, policies, or security of third-party websites or services.
If you leave the Services to access third-party websites or services, you do so at your own risk.
We are not liable for any harm, loss, or damage related to your access to or use of third-party websites, services, resources, content, or products, except to the extent such liability cannot be excluded by law.
Please review the relevant third party’s policies and terms before engaging in any transaction or providing any personal information.
Complaints, claims, concerns, or questions regarding third-party products or services should be directed to the relevant third party.
Section 10 — Relationship with Shopify
Art Lectio is powered by Shopify, which enables us to provide the Services to you.
However, any sales and purchases you make through our store are made directly with Art Lectio.
By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Art Lectio, including any injury, damage, or loss resulting from products or services purchased from Art Lectio.
To the maximum extent permitted by law, you release Shopify and its affiliates from claims, damages, and liabilities arising from or related to your purchases and transactions with Art Lectio.
Nothing in this section limits any rights you may have under Australian Consumer Law or other applicable consumer protection laws.
Section 11 — Privacy
Our collection, use, storage, and disclosure of personal information is described in our Privacy Policy.
Because our store is powered by Shopify, certain personal information may also be collected, processed, stored, or disclosed by Shopify in order to provide checkout, payment, analytics, security, fraud-prevention, and related ecommerce services.
We may also share information with service providers involved in operating our store, processing payments, producing orders, shipping orders, providing customer support, sending emails, preventing fraud, and improving the Services.
By using the Services, you acknowledge that you have read our Privacy Policy.
Section 12 — Feedback, reviews, and submissions
If you submit, upload, post, email, review, or otherwise provide ideas, suggestions, feedback, reviews, proposals, photographs, comments, or other content to us, together referred to as “Feedback”, you grant us a worldwide, royalty-free, transferable, sublicensable licence to use, reproduce, modify, publish, distribute, display, and create derivative works from that Feedback for the purpose of operating, improving, promoting, and marketing Art Lectio and the Services.
This licence applies only to the extent permitted by law and does not affect any rights you may have under privacy, consumer, or intellectual property laws that cannot be excluded.
You represent and warrant that:
- you own or have the necessary rights to provide the Feedback;
- the Feedback is accurate to the best of your knowledge;
- the Feedback does not infringe the rights of any third party;
- the Feedback does not contain unlawful, abusive, defamatory, obscene, misleading, or harmful material;
- the Feedback does not contain viruses, malware, or harmful code;
- you have disclosed any compensation, incentive, or benefit received in connection with the Feedback where required by law.
We are under no obligation to maintain Feedback in confidence, pay compensation for Feedback, publish Feedback, or respond to Feedback.
We may monitor, edit, refuse, or remove Feedback where reasonably necessary, including where we consider that the Feedback is unlawful, offensive, misleading, defamatory, abusive, obscene, infringing, spam, or otherwise objectionable.
You must not use a false email address, pretend to be someone else, or mislead us or any third party as to the origin of any Feedback.
You are responsible for the Feedback you submit and its accuracy. We take no responsibility and assume no liability for Feedback submitted by you or any third party, except to the extent liability cannot be excluded by law.
Section 13 — Errors, inaccuracies, and omissions
Occasionally, information on or through the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, artwork details, pricing, promotions, offers, shipping charges, transit times, product availability, or other information.
We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information where reasonably necessary.
We may cancel or amend an order if any information on the Services or in the order is inaccurate, including after you have submitted an order, where reasonably necessary and permitted by law.
If we cancel an order after payment has been taken because of an error, inaccuracy, or omission, we will refund the amount paid for the cancelled item or order using the original payment method, unless otherwise agreed with you or required by law.

Section 14 — Prohibited uses
You may access and use the Services for lawful purposes only.
You must not access or use the Services, directly or indirectly:
- for any unlawful, fraudulent, harmful, or malicious purpose;
- to violate any applicable law, regulation, rule, or ordinance;
- to infringe or violate our intellectual property rights or the rights of any third party;
- to harass, abuse, insult, harm, defame, slander, disparage, intimidate, threaten, or discriminate against any person;
- to transmit false, misleading, or deceptive information;
- to upload, transmit, or distribute viruses, malware, harmful code, or other destructive material;
- to send unsolicited advertising, promotional material, spam, phishing messages, or similar communications;
- to impersonate any person or entity;
- to collect, scrape, harvest, or track personal information of others without lawful authority;
- to interfere with or circumvent the security features of the Services or any related website;
- to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services without our prior written consent;
- to interfere with anyone else’s use or enjoyment of the Services;
- to engage in conduct that may harm Art Lectio, Shopify, our service providers, or users of the Services.
We may suspend, restrict, disable, or terminate your access to the Services where reasonably necessary if we determine that you have breached this section or any other part of these Terms.
Section 15 — Termination
We may terminate these Terms or your access to the Services, in whole or in part, where reasonably necessary, including if you breach these Terms, misuse the Services, create a security or operational risk, engage in fraudulent activity, or use the Services unlawfully.
You may stop using the Services at any time.
Termination of access to the Services does not affect any order that has already been accepted unless we cancel that order in accordance with these Terms, our Refund Policy, or applicable law.
You remain responsible for all amounts due up to and including the date of termination.
The following sections will continue to apply after termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, Governing Law, Privacy, and any other provisions that by their nature should survive termination.
Section 16 — Disclaimer of warranties
The information presented on or through the Services is provided for general information purposes. We make reasonable efforts to keep information accurate and up to date, but we do not guarantee that all information on the Services will always be complete, current, or error-free.
To the maximum extent permitted by law, the Services are provided on an “as is” and “as available” basis. We do not guarantee that the Services will be uninterrupted, secure, timely, or error-free.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, warranty, right, or remedy that cannot be excluded, restricted, or modified by law, including under Australian Consumer Law.
Our goods come with guarantees that cannot be excluded under Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Section 17 — Limitation of liability
To the maximum extent permitted by law, Art Lectio and its partners, employees, contractors, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of revenue, loss of data, loss of goodwill, or similar losses arising from or related to your use of the Services or products purchased through the Services.
Nothing in these Terms excludes, restricts, or modifies any liability that cannot be excluded, restricted, or modified by law, including liability under Australian Consumer Law.
Where liability may be limited by law, our liability is limited to the maximum extent permitted by law.
Section 18 — Indemnification
To the maximum extent permitted by law, you agree to indemnify Art Lectio, Shopify, and our affiliates, employees, contractors, service providers, and licensors against losses, damages, liabilities, claims, and reasonable legal costs arising from:
- your breach of these Terms;
- your unlawful use of the Services;
- your infringement of any third-party rights;
- your fraud, wilful misconduct, or misuse of the Services.
You are not required to indemnify us to the extent that the relevant loss, damage, liability, claim, or cost was caused by our breach of these Terms, negligence, wilful misconduct, or failure to comply with applicable law.
We will notify you of any indemnifiable claim where reasonably practicable. A failure to promptly notify you will not relieve you of your obligations unless you are materially prejudiced by the delay.
We may control the defence and settlement of an indemnifiable claim, including choice of counsel, but we will not settle any claim requiring non-monetary obligations from you without your consent, which must not be unreasonably withheld.
You agree to reasonably cooperate in the defence of indemnifiable claims, including by providing relevant documents and information.
Section 19 — Severability
If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforceable to the fullest extent permitted by applicable law.
The unenforceable portion will be deemed severed from these Terms, and the determination will not affect the validity and enforceability of the remaining provisions.
Section 20 — Waiver and entire agreement
Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, and any other policies or operating rules posted by us on the Services, constitute the entire agreement between you and Art Lectio regarding your use of the Services and purchases from us.
These Terms supersede any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us regarding the Services.
Any ambiguities in the interpretation of these Terms will not be construed against the drafting party.
Section 21 — Assignment
You may not delegate, transfer, or assign these Terms or any of your rights or obligations under them without our prior written consent. Any attempted assignment without consent will be null and void.
We may transfer, assign, or delegate these Terms and our rights and obligations in connection with a merger, acquisition, restructure, sale of business assets, change of service provider, or similar transaction, provided that doing so does not materially reduce your rights under these Terms or applicable law.
Section 22 — Governing law
These Terms of Service and any separate agreements under which we provide the Services are governed by the laws of Australia and, where applicable, the laws of the Australian state or territory in which Art Lectio is principally located.
You and Art Lectio submit to the non-exclusive jurisdiction of the courts of that Australian state or territory and any courts entitled to hear appeals from those courts.
Nothing in this section limits any rights you may have under Australian Consumer Law or other applicable consumer protection laws.

The headings used in these Terms are included for convenience only and will not limit or otherwise affect these Terms.

You can review the most current version of these Terms of Service at any time on this page.
We reserve the right to update, change, or replace any part of these Terms by posting updates and changes to our website.
Where required by law, we will notify you of material changes to these Terms. Changes will be effective from the date specified in the notice or, if no date is specified, from the date they are posted.
Your continued use of or access to the Services after any changes to these Terms are posted constitutes acceptance of those changes, except where further consent is required by law.
Changes to these Terms will not affect any order that has already been accepted unless required by law, agreed with you, or expressly permitted under these Terms.
